These Terms and Conditions (“Terms”) govern your use of our website www.gutsygreek.com (the “Site”) and the purchase of our products from our Site. By accessing the Site or placing an order, you agree to be bound by these Terms, Shipping and Return Policy and our Privacy Policy, which is incorporated herein by reference. These Terms constitute a legally binding agreement between you ("User", "Customer") and Gutsy. If you do not agree to these Terms, please do not access or use the Site.

1. Eligibility

By using this Site, you represent that

• (a) you are at least 18 years of age or are accessing the Site under the supervision of a parent or guardian who agrees to be bound by these Terms;

• (b) you have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872;

• (c) you are not barred from receiving products or services under applicable Indian law; and

• (d) all information you provide to us is accurate, current, and complete. If you are accessing the Site on behalf of a business entity, you represent that you have the authority to bind such entity to these Terms.
   

2. Product Information & Pricing

• Artisanal Nature: Our Greek yogurt is handcrafted. Slight variations in texture or appearance between batches are normal and a hallmark of artisanal production. Such variations shall not constitute a defect or ground for return or refund, provided the product is otherwise fit for consumption.

• Pricing: All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. We reserve the right to change prices at any time without notice provided that the price applicable at the time of order confirmation shall be the price charged to you.

• Availability: Products are subject to availability. In the event a flavor is out of stock after an order is placed, we will contact you to offer a substitute or a refund. Refunds, where applicable, shall be processed within 5-7 business days to the original payment method.

• Product Description: We endeavour to ensure that product descriptions, images and nutritional information on the Site are accurate. However, we do not warrant that product descriptions or other content on the Site are error-free, complete, or current. Product images are for illustrative purposes only and may vary from the actual product.
   

3. Orders and Payment

• Accuracy: You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. We reserve the right to cancel or refuse any order where we suspect fraud, inaccurate information, or violation of these Terms.

• Payment: We accept payments via [Insert Methods, e.g., Credit/Debit Cards, UPI, Net Banking]. Orders will only be processed once payment is confirmed. We use third-party payment gateways for processing payments. We do not store your financial information (such as card details) on our servers. Payment processing is subject to the terms and conditions of the respective payment gateway provider.
   

4. Shipping and Delivery (Perishable Goods)

• Temperature Sensitivity: Because our products are frozen, delivery is restricted to specific zones [e.g., Mumbai/Pune].

• Delivery Responsibility: It is your responsibility to ensure someone is available to receive the package at the provided address. Since the product is perishable, we cannot be held responsible for melting or spoilage if the delivery is missed or redirected.

• Handling: Upon delivery, products should be transferred to a freezer immediately. Gutsy shall not be responsible for any deterioration in product quality resulting from improper storage or handling after delivery.
   

5. Returns and Refunds

• Food Safety: Due to the perishable nature of frozen yogurt and food safety regulations, we do not accept returns.

• Damaged/Incorrect Items: If you receive a damaged product or the wrong flavor, please contact us at [Insert Email] within 2 hours of delivery with photographic evidence. We will, at our discretion, provide a replacement or a refund.

6. Health & Allergy Disclaimer

• Ingredients: Ingredients for each flavor are listed on the packaging and the Site. Customers are advised to review ingredient information carefully before placing an order.

• Allergens: Our products contain milk and milk solids (dairy) and are produced in a facility that may handle nuts, soy, and gluten. If you have a severe allergy or dietary restriction, please exercise caution and consult your physician before consuming our products. While we take all reasonable precautions to prevent cross-contamination, Gutsy Greek shall not be liable for allergic reactions arising from undisclosed allergen sensitivities or failure to review the ingredient information provided.

• FSSAI Compliance : All our products are manufactured and sold in compliance with the Food Safety and Standards Act, 2006, and the regulations framed thereunder. Our FSSAI License Number is: 11525997000716
   

7. Intellectual Property

All content on this Site, including but not limited to text, graphics, logos, and images, is the property of Gutsy and is protected by Indian and international intellectual property laws. You may not reproduce, distribute, modify, adapt, publicly display, publicly perform, republish, download, store, transmit or use any content without our express written permission. Any unauthorised use of our intellectual property may result in civil and/or criminal liability under applicable Indian law.
 

8. Limitation of Liability

To the maximum extent permitted by applicable law, Gutsy Greek shall not be liable for any indirect, incidental, special, exemplary or consequential damages resulting from the use of our products or the inability to use our Site. Notwithstanding anything to the contrary, Gutsy Greek's total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the Site or our products shall not exceed the amount paid by you for the specific order giving rise to the claim.

Nothing in these Terms shall limit or exclude Gutsy liability for judicially proven: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation.
 

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
 

10. Amendments to Terms

We reserve the right to amend, modify, or update these Terms at any time. The updated Terms will be posted on the Site with the revised date. Your continued use of the Site after the posting of any changes constitutes your acceptance of the revised Terms.
 

11. Contact Information for Grievance Redressal

Any grievance or complaint raised by a consumer shall be acknowledged within -48- hours and resolved within -1- (one) month of receipt.In accordance with Rule 4(1)(c) of the Consumer Protection (E-Commerce) Rules, 2020, and Rule 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we have appointed a Grievance Officer whose details are as follows:
